New Rental Rules India 2025-26. Tenants Get Major Relief! New Rules on Security Deposit, Rent Hike & Eviction

Most people have no idea that new rent rules just started in India. If you live in a rented home or give one on rent, these rules matter more than you think.

Let me explain everything in the simplest way…

RULE 1: COMPULSORY AGREEMENT REGISTRATION

Every rent agreement must now be registered within 2 months of signing. You can register online or at your local registrar’s office. If you don’t do it, the penalty is ₹5,000

(This rule puts everything on record and protects both sides)

RULE 2: SECURITY DEPOSIT LIMIT!

Earlier, landlords could ask for anything, 5 months, 10 months, or even more. But now there is a cap:

Residential homes → maximum 2 months’ rent
Commercial → maximum 6 months’ rent

(This keeps things fair and predictable.)

RULE 3: RENT HIKE RESTRICTIONS!

Rent cannot be increased randomly anymore. The landlord must follow the prescribed guidelines and give proper notice.

(This means no more sudden “from next month rent is higher” surprises.)

RULE 4: CLEAR EVICTION PROCESS!

Tenants cannot be asked to leave suddenly. The rules now define when an eviction is allowed and how much notice is required.

RULE 5: FASTER DISPUTE RESOLUTION!

Rent Courts and Tribunals have been set up to handle rent issues quickly. If there is a dispute, the goal is to resolve it within 60 days.

RULE 6: PROTECTION FOR LANDLORDS TOO!

If a tenant doesn’t pay rent for 3 months or more, the landlord can take the case directly to the Tribunal. Also, the TDS limit on rental income has been increased from ₹2.4 lakh to ₹6 lakh per year, which improves cash flow.

RULE 7: INCENTIVES FOR UPGRADED HOMES!

Landlords who keep rents reasonable or add energy-efficient improvements may get tax benefits under state schemes.

  1. Open your state’s property registration portal, eg, Tennent Registration in Chandigarh
  2. Upload ID proof of both parties
  3. Enter rent and property details
